How about, then, balancing the court as remedy? Four liberals, four conservatives and a neutral chief justice. When a justice leaves the bench, the replacement must be of similar judicial philosophy. Balance is maintained, cases are decided based on merit and the law, and the Supreme Court is no longer a tool of political ideologues. It seems like such a reasonable and obvious solution, I guess there must be something fatally wrong with this idea.
